Solved my problem in 20 days!

I am so very grateful to you both Tasha and Geoff for solving my problem in 20 days after it being unresolved in the legal system for 4 years.

“The eleventh hour” is the common expression, for me it was 2 minutes until 12 when Unhappy Banking came to my rescue to save my home on the Mid North Coast of NSW.

Background

Four years of struggling predominantly on my own, trying to understand the legal system and government bodies set in place to help the people of Australia and not achieving that aim.
October 2010 - February 2011 Private solicitor engaged - unsuccessful
February 2011 - February 2014 ASIC, FOS cclc (consumer credit legal centre) unsuccessful
April 2014 - My property possessed by bank even though I was not handed any papers
May - November 2014 Engaged solicitors - unsuccessful

Melbourne Cup day 2014 The day that stops the nation did not stop Tasha and Geoff. Geoff, Tasha and I had a telephone conference call and as I had been sleeping in my car Geoff organised a safe house for me during that call for that very night until they resolved my problem. 20 days it took Tasha and Geoff to have the bank draw up papers and then I was home in my bed for Christmas.

Accommodation
For the first time in four years I could sleep safely, not having to worry about the bank or their agent stalking my movements. [At home on my property they would drive by to see if I was there or not so they could pounce on an opportunity to take vacant possession, they tried that in 2012 in a very underhanded way.] I felt so safe to sleep in a bed not my car and have a bath to ease the pain of two prolapsed spinal discs. I got to use an iron on my clothes much to my joy. Unhappy Banking also paid for the accommodation for which I am so grateful. Tasha made daily contact with me via phone and email. Geoff was always available if needed. They were always positive in their outlook, kind, compassionate, empathetic and knowingly calm that I would get my property back. My forever home as Tasha lovingly said it.

November 27 Tasha phones me with the good news the bank will draw up a deed at a cut price amount, no interest agreement. It is my birthday and I post on facebook “Best birthday present ever – I am going Home” My birthday got even better at 6.30 pm when Geoff phones and he is within a two minute walk from where I am. I got to meet the man that had never met me and solved with Tasha in 20 days what the legal system could not do in four years. I wish you had been there Tasha, I know I will meet you soon. I am so, so grateful to you both and relieved, totally indebted to you both too.

Tasha it is a shame heroine has such a negative connotation so I made up this acronym for your name Tenacious, Astute, Sincere, Humble, Assertive. Thank You for your kindness, empathy compassion and logical thought processes.

Geoff you are my hero and Australian of the decade for me. I started to write this last week but I got bitten by a bee and I could barely open my eyes so how fitting my eyes have healed today – Australia Day 2015.

I can’t sing your praises long enough or loud enough Tasha and Geoff you are both true advocates of social justice and human rights and as I did on 27/12/2014 and will continue to be so, so grateful. Saturday 27 December. It is Saturday and rains, I go to bed to rest in the afternoon and I laugh for the first time in a very long time and say out loud thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you TASHA AND GEOFF thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you

A long journey, but a successful outcome!

It was September 2012 my wife and I were watching A Current Affair and Geoff Shannon from Unhappy Banking appeared in his quest of taking on the Banks. My wife and I watched the story with a great deal of interest, after the story had finished we looked at each other and said he might be able to help us. I then contacted Geoff via email with our problems and he replied almost instantly suggesting he would be only too happy to help us, within a week we were in his office and he got the ball rolling.

While it has been a long journey, we have had a successful outcome, thanks entirely to Geoff Shannon, it’s very obvious he is a tireless worker and on a mission to make the banks accountable, which is very commendable. The banks being multibillion dollar businesses don’t care, and it’s obvious they have lost touch with and have very little respect for the little people, and they are prepared to squash you like a grape. Without Geoff’s efforts and expertise we wouldn’t have had the outcome we have. 

My family and I are eternally grateful to Geoff and his company Unhappy Banking for achieving a good outcome.

It goes without that saying I would recommend Geoff Shannon if you have a problem with a bank, he is relentless. If in the future I encountered another problem with a bank I would not hesitate to contact Geoff and have him represent me.

I am a lawyer.

I don't want my name published, nor that of my client but I do want to thank Geoff Shannon and Unhappy Banking.

I was assisting clients whom found themselves in dispute with a bank.

When they first came to see me I could not understand why the Bank, BankWest was so aggressive.

The clients ran a small business. They had taken out a loan.

From my investigations and my discussions with the bank they were not in arrears. They had supplied their operating financials. They seemed to be operating profitably.

After investigation I found out that the bank had had the property that they had used as security revalued. The local market had just gone through a dip.

When I called for the valuations the bank told me in short and unequivocal terms that the report were theirs and that they would not release them. The clients were billed for the valuations. It was a bit tough.

From discussions it looked likely that the bank was going to seek possession. There was talk of receivers.

While the clients were running a profitable business, they couldn't afford a legal arm wrestle. I had to find a solution. No matter who I spoke with they could give me no advice other than a  preemptive  application stopping the bank from appointing receivers. The news did not go down well with the clients. They couldn't see that they had done anything wrong, and they couldn't afford a legal fight.

My clients then informed me that they had had discussions with Unhappy Banking. I didn't know who they were, but I do now.

Geoff Shannon went to action. The situation was turned around in literally days. The bank has not been able to appoint receive . The clients remain operating the business and paying the bank the money that they were obliged to under the loan.

Most importantly the clients has the profits from the business to live on. They are putting money away to help accelerate the bank repayment.

These client did not fail in their obligations, but they felt that the bank was just he'll bent on breaking them.

The bank is still not happy but my clients have kept their business going and they now have options to settle up with the bank and avoid the inevitable fire sale that would have occurred if the bank had just bashed their way through.

My client sing the praises of Geoff. I've now met him and he is a man who has had more than his fair share of battles with the bank. He has taught them survival skill, and I have learnt too.

Unhappy Banking is just not a group that are fighting banks. They are real people finding solutions and saving both businesses and lives.

I have no hesitation in recommending Unhappy Banking. Their solutions have worked and they have saved my clients a lot of emotional stress and financial worry, not to mention costs.

To whom this may concern,

I wish to write a character reference on Geoff Shannon.

This will be very plain and simple. Geoff is a hero to many people including my family. He is a down to earth, kind , very considerate and compassionate person with a heart of gold. He has always wanted and still wants to right the wrong. To help innocent victims of financial abuse. He is a very honest and dependable human being.

He is the type of person who would put others before himself and run to help people at a moments notice as we have all seen in the media and not to mention ive witnessed this. In our case, Geoff was there for my parents and myself in their desperate time of need. From the first few moments of meeting him ,his words of support and kindness lifted our spirits and gave us hope. He is the type of person that is always ready to lend an ear and offer advice. Never did he ask for money. He loves to help people with advice. Geoffs warm nature gives people comfort.

He is and always will be a true gentleman in every sense of the word. A great man that adores his family and cares about people he meets.

To my family and myself, Mr. Shannon is regarded as part of our family, he is like the son my mother never had and to myself he is a true friend and a great fighter for peoples rights. Geoff Shannon is the voice of the innocent and hard done by.

Successful Refinance

Hello Geoff

Good news on our part. We successfully refinanced the motel with ANZ. Settlement went through yesterday. It wasn’t without a few hassles and thank goodness for our finance adviser Gary Ward, who represented us and called Bankwest’s bluff regarding another $400 they were going to charge us at settlement. Bankwest backed down on the trumped up fee and it is now all over. We can at least concentrate on the business at hand and get back to running a motel without the sleepless nights. We have definitely been one of the few lucky ones. I can recommend Gary Ward to anyone in Queensland that needs financial guidance to get through. Many thanks to Unhappy Banking that gave us the fortitude to push on. Keep up the good fight and hope you personally see the light at the end of the tunnel. We have been following the Senate inquiry on YouTube and await the outcome end November. We hope it is the right outcome.

It’s unbelievable! This Bank needs to be stopped

I first read about Geoff Shannon and his fight with Bankwest in a Newspaper article on December 2011. It mentioned the unhappy banking website and what he is going through with this Bank. My business has been with Bankwest since 2003 and they had been very good to deal with prior to the takeover by Commonwealth. I have a cashflow business and had never missed an interest payment when Bankwest told me they wanted their money back at the end of 2010. They then doubled their interest rate margin. When the money wasn’t repaid on time due to a property settlement not going through as planned they issued us with a “Deed of Forbearance” that gave us a five month extension, charged us a $200,000 fee, told us an interest rate of 18.8% would be charged if all the money was not paid back at the end of five months and demanded a confidentiality clause so we couldn’t tell anyone what they were doing to us. We tried to negotiate more reasonable terms but they wouldn’t budge so they called in receivers. It’s now seven months later. They have sacked myself and my wife without pay, have receivers charging us up to $525/he EACH, have not sold anything and can’t tell us what’s going on. They are taking all my business profits as well as all the interest payments and the business is starting to deteriorate and lose value under their control. It’s unbelievable! This Bank needs to be stopped.

 

Geoff Shannon and unhappy banking have been an enormous help. By finding out that we are just one of many makes me even more determined to stand up for what is right. We will achieve much more as a group than we ever could individually and knowing I am not alone I have gone to the media and told my story. This in turn has motivated others to come forward as well and I now know our situation with Bankwest is being repeated in different ways throughout Australia.

 

Bankwest and their appointed Receiver / Administrators, accounting firm Taylor Woodings have told me what they are doing is legal. They have demanded that I don’t talk to the media and they have told my staff they will be sacked if they talk to me. If what they are doing is legal, which is questionable, the law needs to be changed. They are knowingly and willingly destroying commercial value to their sole benefit and to the exclusion of everyone else.

 

If Geoff Shannon and unhappy banking can help push for a government inquiry into Bankwests behaviour and the way receiver administrators work perhaps this sort of thing will be stopped. I urge you to listen to the stories of people who have contacted unhappy banking. A lot of them will be like me and have only come forward through finding out they were not alone. If enough good people stand up to this sort of behaviour by our Banks it can be stopped and Australia will be better for it.

 I should say mate - that great Australian term, you have looked after so many fellow Australians in a kind compassionate caring manner  as though every one person is your best mate,  giving your time and putting in so much effort  to help those  that have been infected with this blight caused by the CBA’s actions on so many off us.

In my case you have provided hope to carry on, particularly when I have slipped into that dark place of despair. Additionally it has been a privilege to watch how you have coped in the face of your own despair when the lowest of gutter rat tactics of the CBA have come out of left field in attempts to break you. They have failed on every occasion!

Mate you are a shiny  guiding star, as you have begun to exposed CBA’s corrupt deeds, of which we have seen samples of their fraudulent actions in recent time, the magnitude of their destruction of so very many Bankwest SME’s is beginning to see the light of day. Geoff, I should say mate, What you have done for me and my wife words cannot explain we have been in the depths of despair for the past two years trying to fight Bankwest knowing the bastard act they had done to us as small developers. Your insight through your unhappy network provided hard evidence of what we knew was fraudulent conduct by the bank in appointing receivers to our company.

 

They took all of our assets and money so we could not appoint solicitors but we fought them ourselves through ASIC and the FOS until those power less blind fools said there were no breaches. That was when a miracle occurred we found you unhappy banking!

 

Now with your very kind and compassionate assistance we have a clear direction in seeking retribution from bastard bank and retribution is what we will get!

 

I find it emotionally difficult in what I want to say to you – I choke up trying to put in words my deepest thanks to you.

A Faceless Victim

I'm writing this not as a litigant with the bank but as one of the faceless and voiceless victims who most often bears the brunt of the issues that unhappy banking has brought about – namely the wife / partner of the person embroiled with the bank.

 

We recently finalised our issue with the bank, after 18 months of gut-wrenching turmoil, declining health and just barely holding onto the last vestiges of our sanity. The settlement contract contains a confidentiality clause which precludes any of the issues being given over to public opinion, and I intend to honour our side of this agreement.

 

What I would very like to impart to everyone reading this are the following two points: Never be a victim! No matter what situation you find yourself in, no matter how unfairly the deck is stacked against you – stand up and be counted! This is the true Australian way. Even if it does happen that you are horribly shafted by corporate bullies who behave in the most unconscionable manner, make every blow that you land on them count. Have a good, thorough and honest look at the situation that is the issue between you and the bank. Remember that the bank has almost unlimited resources to fight you, so do not think for one moment that your fight will be easy – it will not! So if you are going to stand your ground against them and say "No more! I will no longer be treated in this manner!" then you need to realise that you are in for the fight of your life – and Good On You for it.

 

The importance of a support network cannot be stated strongly enough, and here I would like to laud Geoff Shannon and his team of close supporters for not only supplying this website as a forum and platform to join in common support, but also to acknowledge and thank Geoff for his gracious and unconditional help which he gave us – help which kept everything in perspective and allowed us to retain our sanity and dignity throughout the ordeal.

 

Geoff, despite your own personal issues with the bank and having been dragged through the proverbial grinder and spat out the other side, your human decency, kindness and simple charity makes you a winner above and beyond any of the individuals that are against you. None of them are fit to look you in the eye, let alone polish your shoes.

 

As either a partner to a litigant, or as a co-litigant, know this – You will need every ounce of your resilience as a human being to prepare yourself for the battle that you have ahead of you. Never falter in your focus, never compromise your ethics. Be true to your beliefs. Constantly support your partner, for if ever your relationship will endure the ultimate test it will be now.

Hot off the press!! Unhappybanking helps get a great result for an unhappy Bankwest customer

Our heartfelt thanks to Unhappy Banking. Our family business was in the depths of despair with Bankwest threatening to call in our loan and put receivers in place when we hadn’t once defaulted on payments. The support of this Group has been phenomenal and just to know that there are others out there who are going through the same terrible fight with the bank has been a comfort to us. Two weeks ago, we were on the brink of losing everything and devastated. Today we have been given a reprieve from the bank and this is all due to the pressure that Unhappy Banking is putting on Bankwest. I’ve now learnt that fighting the bank on your own just doesn’t work but fighting with a group such as this makes the bank sit up and take note that we are no longer going to accept the treatment that they have been dishing out!!

People did what generations have done throughout history, and put their trust in financial institutions to create and sustain businesses, to buy their homes, and feel confident that they were being looked after by a sustainable financial system that would be acting in their best interest as customers and clients. However, they were left feeling like scapegoats. 

You understood what happened to these people. While you experienced the same devastation, you still took on the cause of so many people who had no language and no voice to explain what happened. You have acted over and above your human duty and taken the journey and needs of others to give them hope. 

Nelson Mandela fought for justice for people – it may be a different time, place and reason but this is the same cause. He fought for justice and freedom, just as you are. To quote Mandela, “As we let our own light shine, we unconsciously give other people permission to do the same”. Thanks, Geoff, for having the courage to let your light shine.

To Whom It May Concern

 

I have known Geoff for at least two years now and during that time he has greatly assisted and given support to our family business. We have ongoing concerns with our financier and Geoff has made himself available to us at anytime – both in an advisory and supportive sense.

 

As well as assisting us during this time, I have seen Geoff deal with countless other individuals and businesses who are being harassed and bullied by their Financier. I have in fact spoken to a number of them and like I, none of us can believe that someone would help others such as Geoff does.

 

I have often questioned as to the motive of why Geoff does what he does and the only answer that makes sense to me is that he truly does care about people and feels the need to be a ‘voice’ for others that feel that they can’t stand up to these big Corporations. There is no other logical answer to it.

 

Geoff has plenty of his own problems and family concerns, however he still gets ‘out there’ for others and stands up for their rights which to me is a rare trait in a person. If anyone deserves an Award for assisting others, then Geoff should be right at the front of the line I feel!

 

I wish Geoff every success in his future endeavours and my only hope is that these large Corporations realise that they can’t continue to treat their customers such as they currently do.
